2. Lawyer’s duty of confidentiality
As a lawyer, the controller is subject to the professional duty of confidentiality (§ 43a Abs. 2 BRAO, § 2 BORA, § 203 StGB). All information you provide to us in connection with an enquiry or a mandate (engagement) is treated as confidential.
3. Hosting and server log files
This website is hosted by IONOS SE, Elgendorfer Str. 57, 56410 Montabaur. IONOS processes the data on our behalf on the basis of a data processing agreement (Art. 28 DSGVO).
Each time the website is accessed, the server automatically processes data transmitted by your browser (server log files):
- IP address of the requesting device,
- date and time of access,
- page or file accessed, HTTP status code and amount of data transferred,
- referrer URL (previously visited page),
- browser type and version, operating system.
This processing is necessary in order to deliver the website and to ensure its stability and security (e.g. defending against attacks). The legal basis is Art. 6 Abs. 1 lit. f DSGVO; our legitimate interest lies in the secure and error-free operation of the website. The log files are stored only for as long as necessary for these purposes and are then deleted or anonymised, unless they are required to investigate a specific security incident. The data is not combined with other data sources.
The connection to this website is encrypted using TLS (recognisable by “https://” in the address bar).
4. Fonts and icons
The fonts (Inter, Source Serif 4) and icons (Font Awesome) used on this website are stored locally on our server. When the website is accessed, no connection is established to servers of Google or other third-party providers.
5. Contacting us
a) Contact form. If you send us an enquiry via the contact form, we process your name, email address, telephone number and message and – where you provide them voluntarily – your company and area of law. Mandatory fields are marked as such. The information is transmitted in encrypted form via the email server of our host (IONOS) to our firm mailbox info@advokat-engelmann.de and is not stored on the web server. To protect against automated requests (spam), we use an invisible form field and a time check; we do not use third-party services (e.g. reCAPTCHA).
b) Email, telephone, fax. If you contact us by these means, we process the data you provide in order to deal with your request.
c) Messenger services. You can also contact us via messenger services at the mobile number +49 176 66 888 948. For this purpose we use:
- WhatsApp – provider: WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Irland. Data transfers to Meta Platforms, Inc. in the USA take place on the basis of the EU-US Data Privacy Framework (Art. 45 DSGVO). Privacy information: whatsapp.com/legal/privacy-policy-eea.
- Telegram – provider: Telegram Messenger Inc.; representative in the EU (Art. 27 DSGVO): European Data Protection Office (EDPO), Avenue Huart Hamoir 71, 1030 Brüssel, Belgien. According to Telegram, data of users from the EEA is stored in data centres in the Netherlands; access from countries outside the EU cannot be ruled out. Messages in regular chats are not end-to-end encrypted (only in “secret chats”). Privacy information: telegram.org/privacy.
- Viber – provider: Viber Media S.à r.l., 2, rue du Fossé, L-1536 Luxemburg. Data is also stored on servers in the USA; transfers take place on the basis of standard contractual clauses of the EU Commission or binding corporate rules (Art. 46, 47 DSGVO). Privacy information: viber.com/en/terms/gdpr-privacy-rights.
If you write to us via a messenger, we process your telephone number, your profile name (and profile picture, if any) as well as the content and time of your messages and of the files you send in order to deal with your request. We have no influence on the data processing carried out by the respective provider (in particular metadata, contact matching, transfers to third countries). Use of these services is voluntary – you decide for yourself whether to contact us in this way. For confidential information and documents relating to a mandate, we recommend telephone, post or a personal appointment. Content relevant to a mandate is transferred to the client file (Handakte); chat histories not leading to a mandate are deleted after three months at the latest.
d) Telegram bot @AnwaltRechtBot. Via our Telegram bot (t.me/AnwaltRechtBot) you can send us a structured initial request. The bot asks for the area of law, urgency, country and place of residence, your status, a short description of the matter, details of documents and deadlines, and your contact details (phone, WhatsApp/Viber, email, preferred contact method); in addition we receive your Telegram name, username and Telegram ID. The bot does not provide legal advice and does not make automated decisions. Until you submit, your answers are stored temporarily on our server at IONOS in Germany; they are deleted after submission, when you cancel with the /delete command, and in any case after 48 hours at the latest. Only after your explicit confirmation in the bot is the request forwarded by email to the firm's mailbox and to a closed Telegram group of the firm. The bot does not store files or photos – please do not send documents through it. The information in c) applies to processing by Telegram.
The legal basis is Art. 6 Abs. 1 lit. b DSGVO, insofar as your enquiry is aimed at the initiation or performance of a mandate, and otherwise Art. 6 Abs. 1 lit. f DSGVO (legitimate interest in responding to enquiries). If you provide us with special categories of personal data (e.g. health data, information on criminal offences), we process such data on the basis of Art. 9 Abs. 2 lit. f DSGVO or Art. 10 DSGVO, insofar as this is necessary for the establishment, exercise or defence of legal claims.
Storage period. If no mandate is concluded, we delete your enquiry once it has been fully dealt with, at the latest after three months, unless statutory retention obligations prevent this. Where a mandate is concluded, the statutory retention periods apply, in particular § 50 BRAO (client files: six years) as well as retention periods under commercial and tax law (§ 257 HGB, § 147 AO).
Please note that unencrypted emails are not fully protected against access by third parties during transmission. For particularly confidential information, we recommend contacting us by telephone or by post.
6. Consent management (Cookie settings)
This website does not set any cookies. On your first visit, you can decide in the “Cookie settings” dialog whether external content (currently: Google Maps) may be loaded. Your choice and the time of your choice are stored exclusively in your browser’s local storage (localStorage, entry “cookieConsent”) and are not transmitted to us. This storage is strictly necessary in order to respect your decision (§ 25 Abs. 2 Nr. 2 TDDDG; Art. 6 Abs. 1 lit. c DSGVO i. V. m. Art. 7 Abs. 1 DSGVO). Your choice remains valid for twelve months; after that, you will be asked again.
You can change your choice at any time via the “Cookie settings” link in the page footer or via the following button, or remove the entry by deleting the website data in your browser. We do not use any analytics or marketing services.
7. Google Maps
On the “Contact” page, you can display a map from the Google Maps service. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland (“Google”).
The map is not loaded automatically. Only when you click “Load map” or have allowed “External Media” in the Cookie settings does your browser establish a connection to Google’s servers. In doing so, in particular your IP address, the date and time, the page accessed and browser information are transmitted to Google; Google may use cookies or similar technologies in this context. It cannot be ruled out that data is transferred to Google LLC in the USA. Google LLC is certified under the EU-US Data Privacy Framework; the transfer takes place on the basis of the EU Commission’s adequacy decision of 10.07.2023 (Art. 45 DSGVO).
The legal basis is your consent (Art. 6 Abs. 1 lit. a DSGVO, § 25 Abs. 1 TDDDG). You may withdraw your consent at any time with effect for the future by deactivating “External Media” in the Cookie settings. Alternatively, you can open our address directly at Google via the link “Open address in Google Maps”; in that case, only Google’s terms apply. Further information: policies.google.com/privacy.
8. Links to social networks
Our website contains simple links to our profiles on Facebook, Instagram and TikTok. These are not plug-ins: no data is transmitted to these providers when you access our website. Only when you click on a link are you redirected to the website of the respective provider, where its privacy policy applies.
9. Recipients
Within the firm, your data is accessible only to those persons who need it to deal with your request. External recipients are our host and email service provider IONOS SE (processor), the providers of the messenger services if you contact us through them (section 5 c), and – only with your consent – Google (section 7). Data is disclosed to other third parties only where this is necessary to handle the mandate (e.g. to courts or authorities) or where we are legally obliged to do so.
10. Your rights
Subject to the statutory provisions, you have the right to
- access (Art. 15 DSGVO),
- rectification (Art. 16 DSGVO),
- erasure (Art. 17 DSGVO),
- restriction of processing (Art. 18 DSGVO),
- data portability (Art. 20 DSGVO),
- withdraw consent given, with effect for the future (Art. 7 Abs. 3 DSGVO).
The right of access may be restricted insofar as information is subject to the lawyer’s duty of confidentiality (§ 29 Abs. 1 Satz 2 BDSG).
Right to object (Art. 21 DSGVO). Where we process data on the basis of Art. 6 Abs. 1 lit. f DSGVO, you may object at any time on grounds relating to your particular situation. We will then no longer process the data unless we can demonstrate compelling legitimate grounds or the processing serves the establishment, exercise or defence of legal claims.
To exercise your rights, a message to info@advokat-engelmann.de is sufficient.
Right to lodge a complaint. You may lodge a complaint with a data protection supervisory authority (Art. 77 DSGVO). The authority competent for us is: Berliner Beauftragte für Datenschutz und Informationsfreiheit (Berlin Commissioner for Data Protection and Freedom of Information), Alt-Moabit 59–61, 10555 Berlin, www.datenschutz-berlin.de.
11. No automated decision-making
No automated decision-making, including profiling (Art. 22 DSGVO), takes place.
12. Changes
We will amend this Privacy Policy if the website or the legal situation changes. The version published here at any given time applies.
