Our client, a Ukrainian national, came to Germany for a temporary stay. In the course of settling in, he found he needed a car to get around the country. Not being fully familiar with local law, however, he used a forged driver’s license he had bought online in Ukraine. Unfortunately, this violation soon attracted the attention of the police.
Our client was stopped by police officers during a routine traffic check. A check of his documents revealed that he was using a forged driver’s license. On this basis, he faced serious charges under two separate provisions.
The Charges
Our client faced charges under the following provisions:
Document forgery. Under §267 of the German Criminal Code (Strafgesetzbuch, StGB), forging documents — including a forged driver’s license — is punishable by imprisonment for up to five years or a fine. Using forged documents is treated as a serious offense, as it undermines public trust in official documents and authorities.
Driving without a valid driver’s license. Under §21 of the German Road Traffic Act (Straßenverkehrsgesetz, StVG), driving a vehicle without a valid driver’s license is also a criminal offense. The penalties include imprisonment for up to one year or a substantial fine.
Both charges posed a serious threat to our client, since they carried the risk of actual imprisonment or heavy fines, as well as a subsequent criminal record that could significantly affect his future life in Germany — since information on criminal offenses committed by foreign nationals residing in Germany is forwarded by the public prosecutor’s office to the relevant immigration authorities, which keep records of offenders.
The Legal Defense: Where to Focus
The most important thing our client did was to turn to our law firm for legal help immediately after being charged. German law allows for a special summary procedure for criminal cases — the Strafbefehl (a penal order issued without a trial hearing). If negotiations with the prosecutor’s office succeed, the case can be closed without the client having to appear at a trial hearing at all. That is exactly what happened in our case.
A Fine Instead of a Criminal Record: A Successful Outcome
Based on the agreement reached, the prosecutor’s office proposed issuing a Strafbefehl — a penal order requiring our client to pay a fine of €1,200. This allowed him to avoid serious consequences such as imprisonment and a subsequent criminal record.
It is worth noting that fines imposed in German criminal proceedings generally do not result in a criminal record, provided they stay below a certain threshold. Under §32 of the Federal Central Criminal Register Act (Bundeszentralregister, BZRG), fines not exceeding 90 daily units (Tagessätze) are not entered in the certificate of good conduct (Führungszeugnis), and the person is not considered to have a criminal record.
As a result, our client was able to keep his clean record — important both for his life in Germany and for his future professional career and integration into German society.
It is also worth noting that fines below 90 daily units have no direct effect on a person’s immigration status — another important aspect of the case.
